All parties agree that they have executed a breeding contract to breed the above named mare and stallion. In addition to the breeding contract, it is mutually agreed by all applicable parties that this addendum shall become part of the afore mentioned breeding contract upon signatures of applicable parties.
The Lewis Ranch shall ship semen collected from said stallion in an appropriate chilled semen container by overnight courier, such as Federal Express, DHL, AirNet, etc. to the address of record provided in writing by the mare owner. Semen will be shipped immediately after collection. The Lewis Ranch certifies that the semen, when collected, will be of such a degree of motility and mobility so as to be reasonably acceptable for breeding.
All breeding fees must be paid in full prior to the shipment of semen. Mare owner agrees to pay $175 for chute fees and overnight shipping costs in addition to the stud fee agreed upon in the Breeding Contract. *Shipping Counter to Counter will be an additional $150 as the nearest airport is 1 hour away.
It is mare owner’s responsibility to have a veterinarian or certified breeding technician inseminate the mare, complete all forms required, and return the forms to any respective breeding registries. It is expected that the mare owner’s Veterinarian is aware of the mare’s current breeding status and can ensure that the mare is at the proper stage of ovulation to order semen and inseminate. Mare owner agrees that chilled semen requires special handling and that attempts to breed any mare outside the controlled conditions of an equine reproduction center can greatly reduce, and in some cases, prevent chances of conception.
Mare owner certifies that only the mare listed on the Breeding Contract shall be inseminated by the shipped semen of said stallion without written consent from Stallion owner. *NOTE: If semen is used on a mare other than as stated in this contract, mare owner shall owe a second full breeding fee, and all related expenses, including chute and shipping fees to The Lewis Ranch.
The Lewis Ranch will make every effort to provide semen as requested. Semen availability will be governed by shipping options and number of mares booked at any given time during the breeding season. The Lewis Ranch requests notification when mare first comes into her heat cycle and by 6 pm on the day prior to shipment of semen or shipment cannot be guaranteed. In the instance that semen requests exceed supply, priority will be given to mares in order of booking dates. Note: Booking before January 1 earns a discount on the stud fee and booking multiple mares earns an additional discount for each mare.
The mare owner agrees to comply with all APHA, AQHA or other breed association rules and regulations regarding the use of shipped semen and artificial insemination.
The mare owner agrees to send the appropriate copies of the Insemination Certificate to the breed association and to The Lewis Ranch. Mare owner also agrees to return the shipping container within 7 days via regular ground.
All parties to this contract agree that the obligations of The Lewis Ranch shall be met when the shipped semen is accepted at the address of record provided by the mare owner. Acceptance shall be defined as the shipment container arriving at the address provided by the mare owner and a signature received from a representative of the address provided by the mare owner. The Lewis Ranch assumes no further responsibility for risk of loss once semen container has been accepted.
The Lewis Ranch is not responsible for lost, delayed or damaged semen and makes no representative or warranties of any kind with respect to semen except that it is from the booked stallion and will be of such a degree of motility and mobility when shipped so as to be reasonably acceptable for breeding, will be packaged professionally and that the stallion will have been tested for his cooling/shipping ability.
Mare owner agrees to have pregnancy of mare verified and submitted to stallion owner as soon as reasonably possible.
